あなたの脳はあなたが作ったものですか？あなたの使っている言語はあなたが作ったものですか？あなたの使う算術や数学はあなたが考え出したものですか？あなたの科学的な知識はあなたが初めて発見したものですか？あなたは、親から生まれ、親や周りから色々なことを吸収して育ち、学校で学び、それらが、現在のあなたの考えのベースに成っているのです。

そんなあなたが特許権や著作権を持っているとして、あなたの“オリジナリティーのみ”に帰するところは何処まであるのでしょうか？そもそも、オリジナリティーとは、“現に存在しているものの新しい組み合わせやその初めての発見”でしかないのです（本ブログに掲載されている「堀込清一の宇宙と心」にある「組み合わせとオリジナリティー」を参照してください）。

そうであれば、特許権や著作権に絡む金銭的要求から、その素晴らしい果実を人々が利用することを阻むことには、自然宇宙の法則からも、倫理道徳的にも、多少問題が有るのです。努力に対する報酬、並びに、開発費用等の回収は、当然、必要です。即ち、特許権や著作権は守らなければなりません。しかしながら、現在のグローバリズムに蔓延る過度の金銭的要求、長期に亘るその利用制限は、明らかに歪んだものです。一刻も早く、世界の人々が、たとえ貧しい国々の人々でも、その素晴らしい果実を享受できるよう、新しい制度を作り上げなければなりません。人々の、特に、政治・経済・文化を支配する階層の意識レベルを上げるための啓蒙が必要です。

 

Patent and Copyright

Is your brain made by you?  Is your language made by you? Did you invent the arithmetic or math which you use? Did you discover your scientific knowledge by yourself?  You are born of your parents, grow up by absorbing various things from parents, people around you, of course, from school and they form the basis of your current thinking.

Assuming that you have a patent right or copyright, to what extent does it attribute to your own originality? In a true sense, “originality” means a new combination (or its first discovery) of what already exists in the natural universe. (Please refer to “ Combination and Originality” which you can see in “Universe and Mind written by Seiichi Horigome” for this website.)

Therefore, both from the laws of the natural universe and the ethical viewpoint, there must be some restrictions against patent and copyright’s claiming monetary rewards when people utilize these wonderful fruits. Of course, rewards for making efforts and recovery of development costs are necessary. That is, patent rights and copyrights should be protected. However, their excessive money demands and long validity term prevailing in the current globalism are obviously distorted.  As soon as possible, we must change the rule so that people in the world, even those in poor countries can enjoy these wonderful fruits. Enlightenment is required to raise the level of consciousness of the people who control politics, economy and culture.

えびす様 Ebisu

七福神で、唯一人、日本由来の神様と言えば、えびす様ですが、この神様は竿で鯛を釣り上げている姿が有名です。その意味は、「釣りして、網せず」ということだそうです。これが、長い目で見た商売繁盛の秘訣なのです。商売は、適度の規模で適度の利益を上げて永続させるもので、大網を張って、更に、その網を大きくして、社会の利益を独占するものではないということを教えてくれているのです。

翻って、アメリカ人から教わった現代の大規模ビジネスは、どこに向かって進んでいるのでしょうか。海山を崩す勢いで大網を広げて、自分達だけの目先の利益を追求するその姿勢は、えびす様の「釣りして、網せず」とは、正反対のものです。短期的繁栄を達成しても、長期的に見れば、自滅行為です。自分達が生かされている自然環境の破壊については言うまでもありませんが、大規模ビジネスが生み出す商品やサービスを消費する一般大衆の大部分は、大規模ビジネスによって押し潰されかかっている中小零細企業の従業員です。この人達の購買能力を低下させて、自分達ばかりの繁栄は有り得ないのです。

Speaking of the seven deities of good fortune, the only person who is from Japan, is Ebisu, but this god is famous for catching sea bream with a rod. The meaning is that it means “fish and not net.” This is the secret of prosperous business in the long run. It teaches us that business should not end up by monopolizing the interests of society, but it should make a good profit on a moderate scale and make it last forever.

On the other hand, where is the modern large-scale business taught by Americans going? The attitude of spreading the large net with the force to break the seamount and pursuing the immediate profits of ourselves is the opposite of Ebisu’s “fishing, not netting”. Achieving short-term prosperity is self-defeating in the long run. Not to mention the destruction of the natural environment in which we are alive, but most of the general public who consume the products and services produced by large-scale businesses are employees of small and medium-sized enterprises that are being crushed by large-scale businesses.   It is impossible for large-scale businesses to prosper themselves by reducing  the general public’s purchasing ability.
